90 Day Fiancé star Jay Smith has just been released from U.S. Immigration and Customs Enforcement (ICE) custody after more than four weeks. After turning himself in after having a warrant out for his arrest for breaching the Protection of Abuse Order charge filed by Ashley Martson, Jay was in custody at the ICE detention center where he faced deportation over four weeks.
Jay was thrown into the public eye after premiering on season 6 of 90 Day Fiancé with fiancé Ashley, where he moved from Jamaica to America with the help of the K-1 visa to marry Ashley and make a life with her in America. The couple did marry in May of 2018, but due to Jay’s infidelity and trust issues, Ashley did not file for Jay’s adjustment of status. The infidelity had started just days after their shotgun wedding in Las Vegas, when Ashley caught him messaging multiple women on dating apps. In the latest season of 90 Day Fiancé: Happily Ever After?, Ashley had caught Jay having sex with another woman at the tattoo shop at which he was apprenticing, which ultimately led to Ashley kicking him out of her house and calling the cops when he refused to leave. Later on in the season, he refused to sign the divorce papers on camera. Although the couple was trying to work it out, after Ashley had alleged that she caught him cheating again in April, she filed for divorce a second and final time.
According to Us Weekly, Jay had broken the Protection of Abuse Order charge filed by Ashley by posting about Ashley on social media. He was sentenced to one day in jail, and was turned over immediately to ICE custody due to his immigration status not being adjusted by Ashley. Jay’s friend Kayla O’Brien had set up a GoFundMe for Jay to raise money for legal fees, and Jay was released from ICE custody just two weeks after his hearing by his employer, the owner of Ego Ink tattoo shop. Incidentally, it’s the same tattoo shop in which Jay had cheated on Ashley.
Jay was released on Wednesday, July 31 from an ICE detention center at York County Prison in York, Pennsylvania. Ashley swore to get revenge for Jay’s cheating by making sure that he deported back to Jamaica, and her spokesperson spoke about the situation, saying, “Ashley feels as though Jay made his own bed… Ashley has been suffering for a long time - it’s payback.” It seems the only payback Ashley will have gotten is the four weeks Jay spent in ICE custody. The court has decided that Jay will be allowed to stay in America, for now. As for Ashley, she plans on focusing on her children and career.
It remains to be seen how long the 90 Day Fiancé star will be allowed to stay in America, based off of his messy divorce, legal troubles, and unconfirmed immigration status. For now, he can at least find solace in the fact that friends and strangers alike came together to support him, raising money to bail him out, making him a free man.
